1. About this agreement
These Terms and Conditions govern your use of this website and any enquiry you submit through it. By using the site or submitting an enquiry, you agree to be bound by these terms. If you do not agree, please do not use the site or submit an enquiry.
2. About us and our contractor partner
Campbelltown Landscaping ("we", "us", "our") is a marketing and lead-referral service. We are not a licensed builder, landscaper or trade contractor. We do not provide quotes, perform site visits, supply materials, or carry out landscaping or construction work directly.
All landscaping services described on this website — including design, retaining walls, paving, turf, planting, pool surrounds and outdoor entertainment areas — are provided and performed by our nominated landscaping contractor partner. The contractor partner:
- Is a separate legal entity from Campbelltown Landscaping
- Holds all relevant NSW trade licences for the work performed
- Carries appropriate public liability insurance and workers compensation cover
- Is responsible for all consultations, quotations, materials, workmanship, compliance and warranty
The contractor partner's licence details, ABN, insurance details and contract terms will be provided in writing as part of any formal quotation they issue to you.
3. Enquiries and referrals
When you submit an enquiry through this website or call the phone number listed on it, we refer your enquiry to the contractor partner. From that point onwards, all communication, quotations, contracts and work are between you and the contractor partner directly. We are not a party to those communications, quotations or contracts.
4. Quotations
Quotations for landscaping work are provided by the contractor partner. Quotations are typically issued after a free on-site consultation and are valid for the period specified in the quotation document. Pricing, scope, inclusions, exclusions, payment terms and timelines are set by the contractor partner and form part of the contract between you and them.
5. Payment
All payments for landscaping work are made directly to the contractor partner on the terms set out in their quotation and contract. We do not collect, process or hold payments for landscaping work.
6. Workmanship and materials
The contractor partner is responsible for the quality of workmanship and the materials used in any landscaping work performed under their contract with you. Workmanship is warranted by the contractor partner for a period of 5-year from practical completion, subject to the terms of their contract. Plant warranties are typically 90 days subject to proper care, as set out in the contractor partner's quotation.
7. Access, approvals and council requirements
The contractor partner is responsible for identifying any council approvals required for the proposed work (including DAs for retaining walls, driveways or other structures), and for obtaining those approvals where this forms part of the agreed scope. You are responsible for providing safe and reasonable access to the site for the duration of the work.
8. Cancellation
Any cancellation of work after a contract has been signed is governed by the contractor partner's contract terms, which will be set out in their quotation. We are not a party to the contract and are not involved in cancellation arrangements.
9. Limitation of liability
To the maximum extent permitted by law:
- We are not a party to any contract between you and the contractor partner;
- We are not liable for the work performed, the materials supplied, or any dispute arising from landscaping work performed by the contractor partner;
- Any claim relating to landscaping services — including but not limited to claims about workmanship, materials, delays, scope changes, damage to property, or warranty — must be directed to the contractor partner under your contract with them;
- Our role is limited to referring your enquiry to the contractor partner. Once that referral occurs, our involvement in the project ends.
This clause does not exclude or limit any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
